Please refer to your letter No. IC/SSI/Policy/3/244, dated 24th January, 1992 on the above subject. In this connection, I am to state that from time to time clarifications have been issued in this regard. I enclose a copy of this office letter No. 5(1)/82-SSI Bd. dated the 31st December, 1982 issued in this regard, which is self-explanatory.

Since the issue has been raised again, the matter is being clarified once again as follows: -

    As per the provisions contained in the notification issued under the IDR Act in respect of the definition of Small Scale and Ancillary Industrial Undertakings, it is stated that no small scale or ancillary industrial undertaking shall be a subsidiary of or be owned or controlled by another industrial undertaking (refer notification No. S.O. 232 (E), dated 2.4.1991).

    Units set up by the State or Central Govt., by public sector undertakings or by any State owned enterprises or body would, therefore, not come under the definition of small scale or ancillary industrial undertakings. Hence, it is reiterated that such units, which are owned, controlled or is a subsidiary or any State owned registrable as small scale or ancillary industrial undertaking. Under the circumstances, it is requested to de-register any such units in future.

You may kindly indicate the action by you in this regard.
