S.O. (E).- In exercise of the powers conferred by sub-section (1) of section 11B and sub-section (1) of section 29B of the Industries (Development and Regulation) Act, 1951 (65 of 1951), the Central Government hereby makes the following further amendments in the Notification of the Government of India in the Ministry of Industry (Department of Industrial Policy and Promotion) number S.O. 857 (E), dated the 10th December, 1997, namely:-

Note :- The Principal Order was published in the Gazetted of India Extraordinary vide number S.O. 857(E) dated 10th December, 1997 and subsequently amended vide S.O. No.1288(E) dated the 24th December, 1999 , S.O. 1013(E) dated the 9th October, 2001, S.O. 655(E) dated the 5th June, 2003 and S.O1109(E) dated the 13th October, 2004

Hon’ble Minister for SSI & ARI has approved

a) Enhancement of investment in plant and machinery in respect of items being manufactured in Drugs and Pharmaceuticals Sector in SSI from Rs.1Crore to Rs.5Crore; and

b) Enhancement of investment in plant and machinery in respect of 69 items of different disciplines figuring in the list of items reserved for manufacture in Small Scale Sector.

2. Accordingly draft notification has been attempted and is placed below for being sent to the Ministry of Law and Justice , Legislative Department, for vetting. As may be seen therein the draft notification has the details of 69 items has in addition to item ID number and item name & a col. for Sl. Number, which is must because there are many sub-groups involved and it may not be possible to distinguish if the Sl.No. is not given. In other notified items/ notification issued earlier, there was no such problem.

3. The vetted notification will have to be got translated from the Directorate of Raj Bhasha. Once this has been done, the final draft will have to be sent to the Ministry of Commerce and Industry, Department of Industrial Policy & Promotion, IP Division for placing the same in both Houses of the Parliament for a total period of 30 days which may be comprised in one session or in two or more successive sessions in accordance with the Sub-Section I of Section 11(B) and Section 29(B) of Industries Development & Regulation Act, 1951. If there is no amendment/change/disapproval suggested during the stipulated period of 30 days, the final notification shall be issued only after waiting for a complete session following the session in which 30 days of laying of the draft notification in the House is completed.

4. At present another draft notification, proposed earlier, for enhancement of investment in respect of items reserved for manufacture in SSI in Sports Goods is under consideration for issue with the Department of Industrial Policy & Promotion. The legalities of placing the said notification has been completed. The S.O number will be inserted when the notification is finally issued, which is likely to take place by end of October 2004.

PUC is from Department of IPP, who have sought product code in respect of “Drugs and Pharmaceuticals Sector”, the investment limit for which is proposed to be raised from Rs.1Crore to Rs.5Crore along with the 69 other reserved items. The file in original along with the draft notification, duly vetted by the Legislative Department (Ministry of Law & Justice) and hindi translation to the IPP Divn for placing the notification on the table of the House during Session in accordance with the provisions of the ID&R Act. The file has been returned back with the said request. There appears some confusion. The codes have been sought for the items to be covered in “Drugs and Pharmaceutical Sector” (reserved). The fact remains that the investment limit for 10 items reserved in Drugs and Pharmaceuticals Sector was raised vide S.O.655(E) dated 5th June, 2003. This particular proposal is raising the investment limit respect of the Drugs and Pharmaceutical Sector as a whole, irrespective of the fact whether the said item is reserved or not in Drugs and Pharmaceuticals Sector for the reasons explained at page 5-6/N, duly approved by the Hon’ble Minister of SSI.

Subject: Issue of notification for enhancement of investment limit from Rs.1Crore to Rs.5Crore in respect of 69 items reserved for manufacture in SSI Sector and the “Drug and Pharmaceuticals Sector as a whole – Clarification regarding

This has reference to your OM No. 7(3)/99-IP (Vol.III) dated 23rd December, 2005 seeking the code of items sought to be covered under “Drugs and Pharmaceuticals Sector”(reserved). In this connection it may be stated that the investment limit in plant and machinery for 10 items reserved under Drugs and Pharmaceutical Sector has already been enhanced from. Rs.1 crore to Rs.5 crore w.e.f 5th June, 2003 vide SO.655 (E) (copy enclosed for ready reference). In view of pressing demand of statutory requirement of revised Schedule M (Good Manufacturing Practice – GMP), of the Drugs and Cosmetics Act 1940 and WTO requirements from January, 2005, the proposed notification is for the items which fall under Drugs and Pharmaceuticals Sector in addition to those which are reserved in SSI Sector In short the enhancement of investment limit is for all the items in the Drugs and Pharmaceuticals Sector, irrespective of the fact whether the items is reserved or not reserved,. In addition, for other 69 items, which are reserved for manufacture in small-scale industries (SSI) Sector, product codes have already been mentioned in the said draft notification (duly vetted by the Legislative Department) for placing the same on the table of the House under the provisions of ID&R Act, 1951. The copy of the draft notification is enclosed along with its Hindi version (translation carried out by the Rajbhasha Khand – M/o Law and Justice, New Delhi). for further action at your end. The original file which was sent back to this office along with your above OM has been retained in this office.

This issues with the approval of the JDC (SSI Board & Policy).
